Attached-Lid Crate Rental Agreement

This Rental Agreement (“Agreement”) is entered into by and between Bin & Co. (“Company,” “we,” “us”) and the customer identified below (“Customer,” “you”). By signing this Agreement, Customer agrees to the terms and conditions set forth herein.

1. Rental Fees & Deposit

Customer agrees to pay the following charges in connection with this rental:

The security deposit will be refunded within a reasonable time after crates are returned, less any deductions for damage, loss, extended rental fees, or cleaning as described below.

2. Damage, Loss & Cleaning Fees

If any rented crate or lid is damaged, lost, or returned in a condition requiring excessive cleaning, Customer will be charged according to the current fee schedule provided at booking, in addition to any applicable extended rental fees. Normal wear and tear from ordinary use is not subject to a damage fee.

3. Customer Responsibility for Loss or Damage

Customer is fully responsible for the cost of repairing or replacing any crate or lid that is lost, stolen, or damaged during the rental period, as well as any charges for excessive cleaning, according to the fee schedule described above. Bin & Co. will invoice Customer for any such amounts, which are due upon receipt of the invoice.

4. Customer Responsibilities

• Use crates only for packing and transporting household or business items.
• Keep crates dry and out of direct exposure to rain, snow, or standing water.
• Avoid overloading crates beyond a reasonably safe weight for one or two people to lift.
• Do not use crates for hazardous, flammable, illegal, or perishable materials.
• Return all crates and lids by the agreed date in substantially the same condition as delivered, reasonable wear and tear excepted.
• Make crates reasonably accessible for pickup at the agreed date, time, and location.

5. Company Responsibilities

• Deliver clean, functional crates with attached lids on the agreed delivery date.
• Replace any crate or lid found defective at delivery, at no additional cost.
• Collect crates on the agreed pickup/return date, or a mutually rescheduled date.

6. Liability & Assumption of Risk

Company is not responsible for damage to items packed inside the crates by Customer. Customer assumes responsibility for properly packing, securing, and handling the contents of each crate. To the fullest extent permitted by law, Company's total liability under this Agreement is limited to the amount of rental fees paid by Customer.

7. Term & Early Return

This Agreement begins on the delivery date and continues until crates are returned and all fees are settled. Customer may request early pickup; extended rental fees will not apply for days after Company receives a return request, provided pickup can be scheduled within a reasonable time.

8. Indemnification

Customer agrees to indemnify and hold Bin & Co., its officers, agents, and employees harmless from and against all liabilities, claims, actions, proceedings, damages, losses, costs, and expenses, including attorneys’ fees, for any injury or death of any person or damage to any property arising from or connected with, directly or indirectly, Customer’s possession, use, or return of any rented crate(s). Customer is solely responsible for the operation of the crate(s) and for returning them in good working order. Bin & Co. and its officers, employees, and agents are not responsible for any injury to Customer or to any other person using the crate(s), and Customer agrees to hold Bin & Co. and its officers, employees, and agents harmless against any injury or property claims. Customer shall indemnify Bin & Co. and its officers, employees, and agents against any costs incurred due to claims from any person, including attorneys’ fees and related costs, involving the use and return of the crate(s), should any legal action become necessary.

9. Governing Law

This Agreement is governed by the laws of the State of Texas.
